Life Insurance claims may be declined because cover was not active, the claim falls outside the policy’s terms, or material disclosures are disputed within the legally permitted period. Missing paperwork can also delay processing. Ask for the insurer’s written reason before deciding whether you need to supply evidence, correct a record or challenge the decision.

What is the difference between a rejected and delayed claim?

A rejected claim is an adverse decision about entitlement to a benefit. A delayed claim may still be under assessment while evidence is collected or the recipient’s entitlement is established. Check the status in writing and ask what remains outstanding. A document request alone does not explain why a claim would be refused. Ask the insurer to identify the exact benefit being assessed and whether it has issued a final decision.

Keep the claim reference, submission acknowledgements, and correspondence together. This gives you a clear record if the matter later becomes a complaint.

Can incorrect disclosures lead to claim rejection?

Incorrect or withheld material information can lead to a dispute, subject to Section 45 of the Insurance Act, 1938. The insurer must meet the applicable legal requirements. Every error is not automatically fraud. Where the insurer challenges the policy, examine the specific allegation, and the evidence supporting it. As a practical precaution, read each proposal question yourself and answer accurately. Do not assume a medical test replaces the questions you must answer.

Keep the submitted proposal and any written clarifications. If asked about tobacco use, treatment, occupation, or existing cover, answer the actual question rather than guessing what matters.

What protection does Section 45 provide after three years?

Section 45 prevents a Life Policy being called into question after three years from the latest applicable date: issuance, commencement of risk, revival, or a rider date. This protection does not create a benefit outside the contract or restore lapsed cover. It should not be described as automatic acceptance of every claim. Within the permitted period, statutory requirements govern challenges for fraud, or material misstatement.

Ask for the written grounds and supporting materials. A recent revival can matter even when the original policy is older. If the insurer relies on Section 45, obtain advice on the relevant dates and its stated ground.

Can missing premiums affect the death benefit?

Missed premiums can affect whether cover remains active. A grace period may preserve cover temporarily, while a lapse or reduced paid up status can change entitlement. Read the policy’s provisions rather than assuming that one missed payment ends all benefits. Revival may require approval as well as payment of arrears. Build a payment timeline using receipts, bank records and servicing notices.

Ask for the policy status on the date of death and any written revival acceptance. If the insurer alleges lapse but you have evidence of timely payment, include it in your review request.

How do exclusions affect a claim?

An exclusion limits cover for a specified circumstance. Read the clause for the particular benefit claimed, including any commencement or revival conditions. Do not assume that all Life Policies have identical exclusions, or that the same rule applies to an optional additional benefit and the base death benefit. Suicide clauses commonly refer to death within 12 months of commencement of risk or revival, as applicable.

An amount may still be payable under the clause even when the normal death benefit is excluded. Check the policy’s calculation and conditions; do not assume a full premium refund.

Which documents should a nominee prepare?

Use the insurer’s current checklist for the relevant claim type. A death certificate, claimant statement, identity, and bank evidence may be required, with medical or police records depending on the circumstances. Ask how to handle a missing document and retain proof of what you submit. Requirements can differ between early and other claims. For an unnatural death, check whether the insurer needs police and postmortem records.

Tell the claims team if a record is awaited by an authority. Do not alter documents to make names or dates match. Request a proper correction from the issuing body and explain the discrepancy.

Can nomination or ownership issues delay payment?

A claim can require additional evidence where the nominee has died, is a minor, or where the policy has been assigned. This concerns who is entitled to receive the money, and should be distinguished from whether a covered event occurred. Ask the insurer which legal or relationship documents are necessary. Policyholders can help by reviewing nomination details after family changes and keeping assignment records accessible.

Tell family members where the policy and servicing contacts are stored. Provide secure access arrangements for necessary records without circulating passwords or one-time codes.

What should you do after a claim is rejected?

Request the decision letter, the policy clause or legal provision relied upon, and the supporting evidence. Compare these with the proposal, payment record, and claim documents. Send a written review request explaining the disagreement and attaching relevant records. If unresolved, use the insurer’s grievance process before pursuing eligible external complaint routes. Organise your response around the stated reason.

For a payment dispute, provide receipts. For a disputed declaration, provide the submitted answer and related correspondence. Ask specific questions instead of submitting the same papers repeatedly. Keep the grievance reference and decision date because complaint deadlines matter.

Where can you escalate an unresolved complaint?

Bima Bharosa allows you to register and monitor an insurance grievance through IRDAI’s system. The Insurance Ombudsman is a separate redress route with eligibility conditions. You should first complain to the insurer. Check the Council of Insurance Ombudsmen’s current procedure before submitting an Ombudsman complaint. The Council’s portal permits an eligible complaint if the insurer’s response is unsatisfactory or no reply arrives within one month.

It states a one-year filing window from the relevant rejection or expiry of the response period, and a compensation ceiling of ₹50 lakh. Other admissibility conditions apply. Seek legal advice where entitlement or the appropriate forum is disputed.
